At Opia, our products are carefully selected, of high quality standards and we always make the effort to assist you according to your needs. To make your shopping experience as easy and smooth as possible we have put together a few points that apply to all online purchases:
Opia GmbH, Lagerstrasse 72, CH-8004 Zürich (hereinafter referred to as Opia) sells goods to business / private customers (hereinafter referred to as "customer" (male and female form for simplicity reasons) offered in the online shop with the following conditions of sale and delivery (GTC).Prices for supplies and services in this contract are in Swiss Francs, below abbreviated as CHF.
The contract between the customer and Opia is not concluded until the order placed by the customer is accepted by Opia. The order is made on the internet and is binding. Opia accepts the order by providing the customer with an order confirmation via email.
3. Product Range
The information the customer receives during the ordering process concerning the goods is partially based on details provided directly by the supplier and is subject to change. Opia makes an effort to present and describe the goods as realistically as possible. A slight deviation in colour through presentation on the monitor or a print out can not be excluded. All product descriptions are only available in English. If you are uncertain about an English description, please contact us for descriptions in German, Italian, French or Romansh.
4. Payment and VAT reduction
All published prices are indicative prices that are continuously adjusted to the market. These are in Swiss Francs (CHF), including VAT (MWST.) for all customers in Switzerland.
For customers outside of Switzerland the published prices exclude VAT. Your local VAT will apply once you import the purchased items. The VAT will be invoiced from our logistics partners (DHL, UPS, FedEx). For customers, the valid prices (excl. VAT) are always the ones published in the order confirmation sent by Opia.
5. Delivery Time and Stocks
Products in stock are immediately delivered to the address specified by the customer (within 1-2 working days for Swiss deliveries). Otherwise a written confirmation with the expected delivery date will be sent to the customer.
Opia works in close cooperation with its suppliers and the inventory displayed in the online store is automatically adjusted.
Should a product nonetheless no longer be available no delivery will follow and Opia may withdraw from the contract. In this case the customer will be fully reimbursed.
The goods are delivered from Zürich. Deliveries within Switzerland are free (Swiss Post Economy). For deliveries within Europe (EU and non-EU countries) up to a merchandise value of 399,99 shipping costs of CHF 20.- will be charged (delivery time 1 - 5 working days). For international shipments up to a purchase of CHF 399,99 a fee of CHF 30.- will be charged. All purchases over CHF 400 will be sent for free.
Any additional costs during the import process for customs, clearance and compulsory taxation at the delivery address specified by the customer will be borne by the customer.
The specified delivery times are to be understood as a reference and cannot be guaranteed by us.
Opia accepts credit- and prepayments. Credit Card payments are handled through our payment provider stripe. Payment is due at the order confirmation by Opia.
7. Return Policy
The customer has the right to withdraw from the contract within 14 working days without justification and to return the goods. Please return the items in an undamaged, functional, complete state and in undamaged, original packaging. Please notify us at firstname.lastname@example.org so we can confirm your return. If no written return notice is given, an administrative fee of CHF 30.- will be charged. The right of return begins with receipt of the goods by the customer. The customer pays the shipping cost of the return and bears any risk and liability of return shipments. We recommend tracked and/or insured shipments.
Please contact us if you want to return the goods after the deadline so we can look for a suitable solution for you.
No right of return on clearance sales (sale), swimwear, underwear, personal care products, sanitary products and perfumes.
8. Warranty for Defects and Liability
Products will be replaced or repaired free of charge if the defect is reported by the customer within 14 working days in writing after the receipt of goods. If a product is no longer repairable or replaceable, it will be replaced with an equivalent successor product, will be exchanged or a credit will be given. Opia is not liable for damages that are caused by incorrect use or natural wear and tear or for damage not caused to the delivery itself (consequential damages).
9. Intellectual Property
Opia reserves all rights for any design, text or graphics on their website. Copying or any other reproduction of the entire website or parts of it requires written permission (via email) by Opia. All other trademarks, product names, company names or logos quoted on this website are the property of their respective owner.
10. Data Protection
Opia ensures the adherence of the Swiss Data Protection Act and the relevant legal regulations whilst processing and using personal data. The accumulated customer data during the ordering process will only be used for internal market research purposes. A transfer to third parties occurs only for order processing and shipping and is absolutely necessary for proper service and delivery. The customer agrees to this use of his data.
11. Jurisdictions and Applicable Law
The present terms and contracts concluded under this GTC are subject to Swiss law, excluding the UN purchase right (CISG). Place of jurisdiction is Zürich.
12. Final Provisions
The conditions apply exclusively in the version valid at the time a purchase at the Opia online shop is made. These terms and conditions apply in particular if they should differ from those of the customer. Opia reserves the right to changes of these terms and conditions at any time.
